Secondhand Clothing Trade in Contemporary Consumer Culture: A Fiqh Muamalah Analysis

This study examines the practice of secondhand clothing trade (locally known as thrift) in a traditional market setting from the perspective of fiqh muamalah within the broader context of contemporary consumerism. The growing demand for affordable fashion has intensified the circulation of used clothing, raising ethical and legal concerns related to transparency, pricing inconsistency, product quality disclosure, and elements of gharar (uncertainty). Employing a qualitative approach through in-depth interviews and field observations, this research analyzes the conformity of such practices with Islamic commercial law principles. The findings indicate that several transactional practices, including concealment of product defects, lack of pricing transparency, and absence of consumer guarantees, contradict fundamental principles of honesty (Sidq), fairness (ʿadl), and mutual consent (taradi) as emphasized in the Quran (4:29) and prophetic traditions. This study argues that the persistence of non-transparent practices reflects a tension between market-driven consumer culture and normative Islamic business ethics. By situating empirical findings within the framework of fiqh muamalah, this research contributes to the contemporary discourse on Islamic commercial law and highlights the need for regulatory awareness, ethical education, and institutional oversight in traditional markets.
